Building capacity in the Indonesian Courts to improve the availability of Alternate Dispute Resolution (ADR)

The Australian Mediation Association was invited by the Family Court of Australia in Melbourne on Monday 7 October, as a guest of the Chief Justice, to present to a delegation of Indonesian Judges on our ADR experiences and lessons learnt in the implementation of court annexed mediation in Papua New Guinea.

Topics discussed included the role of mediation in providing access to justice (especially for those who are socially and economically disadvantaged), an overview of the Mediation program in PNG,  what does it look like, who benefits, how was it implemented, and the results to date.  Discussions were also held around the training and accreditation of mediators.

The purpose of this visit was to investigate the  legislative framework for the operation of ADR in Australia, the various forms of ADR in use in Australia and its possible application in Indonesia; the use of pre-action protocols, restorative justice and collaborative law programmes; and the implementation of mediation standards, accreditation and training. The AMA presented on its experiences in training and accreditation and the support and mentoring of the court annexed ADR program in the PNG National Court.
