Continuing Professional Development Program 2018

The proposed CPD program for the AMA is intended to cover mediation skills, practice and specific content areas. The CPD workshops will be identified as either skills sessions or speciality sessions to assist in selection. The program will appeal to mediators from all different disciplines.

27 February 2018 (5.00pm – 6.30pm) “Confidentiality”

Confidentiality is at the heart of dispute resolution but it has different meanings for the different processes. Even in mediation, confidentiality can take on many meanings depending on the type of mediation and the discipline of the mediators. This seminar will look at the meaning of ‘confidentiality’ from a theoretical point of view and more importantly how it plays out in practice.

Mediation refresher #1: This webinar will cover defining mediation and how it fits along the ADR spectrum. The different models of mediation will be identified and how they can assist in resolving different disputes. The focus of this webinar will be on the facilitative mediation model, what it looks like and the participants will be walked through the stages of the process and strategies and tips for working with the model will be highlighted.

Mediation refresher #2: This webinar will focus on the skills associated with mediation, it will highlight the skills and how best to use them to assist parties in moving through the mediation process. It will also highlight some of the areas that give both new and experienced mediators difficulty, how to work with the impasses and obstacles that come in mediation and how best to handle highly conflictual parties and situations.

29 May 2018 (5.00pm – 6.30pm) “Conflict analysis”

Dispute resolution has at its heart the resolution of conflict. It is important to analyse the conflict, as the type of conflict will impact not only on the process that needs to be engaged but also it will assist the mediator in developing strategies to work with the parties. This seminar will look at the different types of conflict and what makes some more suitable for dispute resolution processes and while some need to be dealt with in a different way.

What is ‘reflective practice’ and why as mediators and dispute resolution practitioners do we need to develop and maintain a reflective practice? The seminar will highlight the theory underlying reflective practice and how and why reflective practice as a mediator is important no matter what stage of your career you are at.

25 September 2018 (5.00 – 6.30pm) “Exploration”

To explore is to find out…isn’t this at the heart of  mediation. This seminar will look at how the ‘exploration’ stage of mediation is important for all models of mediation . Unless the interests, needs and concerns can be uncovered then any agreements that are reached are likely to be unsustainable and how exploration can be used to provide closure to the issues between the parties. This seminar will look at exploration in both facilitative and settlement forms of mediation. It will highlight some strategies and techniques to assist in using exploration effectively.

High conflict and highly conflictual parties always raise concerns for mediators, how do we manage them? What process best suits the situation and the parties? Can we really work with ‘high conflict’?

These are the questions that will be explored. The strategies and theories will be identified and participants will encouraged to share their experiences and expertise.
