Hong Kong – This (at least) is Not Confidential – The Mediation Ordinance in Hong Kong Became Operative on 1 January 2013

The Mediation Ordinance (MO), which was officially enacted on 22 June 2012, has come into effect on 1 January 2013. The MO however applies retroactively to agreements existing before it to mediate and past mediations.   The MO basically sets in purposes in promoting mediation as an alternative dispute resolution, provide a regulatory framework for the conduct of mediation, give the confidentiality of mediation communications which is traditionally one of the pillars of mediation.
