The New Commercial Arbitration Acts: Five Points to Remember

The new Commercial Arbitration Acts step towards uniformity in domestic arbitration legislation. The paramount object of the new CAAs is to facilitate the fair and final resolution of commercial disputes by impartial arbitral tribunals without unnecessary delay or expense. These CAAs provide for five important changes such as: prevent parties from litigating in breach of the arbitration agreement;  increase powers of arbitral tribunals  to protect arbitration proceedings; confidentiality being an essential feature of domestic commercial arbitration; judicial review is generally limited to ensuring the structural integrity of proceedings; and enforcement of awards.
